Divorce is never something that anybody wants to go through and when there are children involved it is even harder for every one involved. Child custody must be decided when there are children involved in a divorce and that is a situation that can become very nasty very fast.
In child custody issues a divorce court room may become very similar to a battle ground. These types of ugly child custody cases will try to be avoided if they can. It is better for everyone involved if the parents of the children can amicable and come to an agreement that benefits everyone and not just them selves. When spouses get angry about other issues that they may have had in their marriage it may carry over to the court room of their divorce and their child custody case. This really should be avoided.
In some cases a judge may decree that the family and both spouses be evaluated by a specialist. They may come into the home and see how the child or children exists with both parents and how they live. They will look at how each parent expresses him or her self and how they interact with the children. They will also look at the environment that the child is living in and the surroundings. These findings are not always taken into consideration though and ultimately the judge has the last word in the case.
In other cases that child custody must be decided the parents may not be fighting with each other and they may agree that joint physical custody is the best thing for the child or the children in the case. The judge may agree with them and then the custody of the child or children will be shared between the two parents. This is always the best choice the child or the children can continue to have a relationship with both of their parents as they should. In many cases the parents will choose to live in the same area so the children can go to the same school and play with the same friends. This works out well when the parents are trying to minimize the amount of change that the child or children must go through because of the divorce. When the parents can get along and they can both function in the raising of their children it is the best for everyone. In a joint physical custody agreement the time the child spends with each parent will be divided as equally as it is possible.
In other cases physical custody may be awarded to only one parent and the other parent may have visitation rights to the child or children. This is when the child lives with one parent and the other parent has certain days in the month that they can see the child or children.
There are many different ways a judge can decide on child custody between parents. They may have to decide on child custody solely upon what they have seen in the courtroom but most of the time the judge will take into consideration any statements from the parents. It is always best when the parents of a child or children can get along for the sake of the child and will allow the other parent to be involved in the children’s lives. A child needs both their parents to be able to grow up a balanced individual and as responsible parents they should always put away their differences so the child or the children can experience both of their parents in their life.
