An amicable divorce is so much easier for many people.




Divorce is usually not a very pleasant thing to go through.  Divorce can be very hard for many people and there is usually not a very friendly parting.  However there are some people who feel that a divorce would be the best thing to do and they are very amicable.  These are the kinds of divorces that are pleasant, well as pleasant as a divorce can be anyway. 

If you are going through a divorce but you are lucky enough to be one of those couples that are choosing to be very amicable in the situation than you are in a much better state than most couples who go through a divorce.  Going through a divorce will be easier for you when you can get along and try your hardest to agree on most of the issues.  If you can agree on things like who gets what property and how you will split up the custody of any children you are indeed lucky. These are typically the most fought about issues of any divorce.  People who are going through a divorce will typically fight over most any issue but splitting the property and also the custody of the children are the two major issues.  Again if you are lucky enough to have been in a relationship that is based upon friendship you may be able to discuss these issues with each other and then be able to come up with a good solution with out having to battle it out in a court room.  If you can do this then you should definitely consider yourselves very lucky indeed.

On the other side of the coin there are the couples that fought all through their marriage and in turn will fight all through their divorce.  They will battle over every issue that they can possibly think of to fight about.  They will battle over the custody of the children, they will battle over the amount of child support that will be paid, and they will battle over any and all division of mutual property.  There is nothing that a couple like this will not fight about.  Everything they decide on will have been decided upon because their divorce attorneys helped them and negotiated things out for them. 

Ultimately any couple that is getting a divorce will have to go in front of a judge and have the divorce finalized.  They will have to go to court with their lawyers and the judge will hear their cases.  Then the judge will decide on what to do.  The judge will decide on who gets what and who gets the children and any other issues.  If the couple has already decided upon many of the issues that are put before the court the attorneys will let the judge know that and from that point the judge will typically go along with what the couple has already decided.  This makes for an easy and quick court appearance and the divorce will go quickly.

When there are many issues that the couple can not decide upon then they will have to be in court much longer than a couple that can agree on many things.  When you are in the court the judge will hear many things and since there is no cooperation among the couple the judge will have to hear why both sides should get what ever it is that they think that they should get. This is a much longer process and it can be drawn out for a very long time indeed.  Any way that you are going to be whether you fight the whole time or you both can agree on many points of the divorce you will still have to obtain an attorney. A divorce may not have to be the worst thing that has ever happened if you try to get along a little bit.
