Who gets child custody in a divorce?
Divorce is never an easy thing to go through for anyone. There are the occasional couples that get a divorce and it works out very well and there is not a big deal that is made about their divorce but these couples are usually not married too long and do not have too much property to split or any children to decide custody about. When a divorce hits a family it can be devastating to all that are involved but especially to the children.
You see the children will typically blame themselves for their parents’ divorce. The children will take full blame for all of the problems that their parents have gone through. They will think that if they were better behaved their parents would still be together. The children will typically believe that if they were quieter or if they did better in school then their parents would still be together. Children will really blame themselves for things that could not possibly be their fault. And in all of their self guilt these children will have to see their family split apart and their parents divorce. It is a very hard thing to go through even for an adult.
When a family goes through a divorce the children will have to be placed with one of the parents for the majority of the time. If it is a divorce that is very ugly and messy then the judge will have to decide which parent is better for the children to live with on a full time basis. Many times a judge will try to give joint custody of the children to both parents and the child or the children will have to split up certain days of the week when they are with the other parent. They may be with their mother for beginning of the week and then the father at the end of the week. There may be weeks that are split up with several days being spent with the mother and several days being spent with the father.
There are times though that even in a divorce there are parents who only care about what their children need. So they will try and agree on what is best for their children and have their divorce attorneys inform the judge of a civil and amicable decision that the parents have come to about their children’s custody. This is always the best way for the children and the divorce attorneys will agree. If there is a way that the child custody can be agreed upon and worked out between the parents it is always best for everyone involved.
There are however parents that will want to keep their children away from the other parent just to hurt them. a judge will not allow this to happen. If there is proof of some kind of abuse to the child or the children at the hands of a parent then the judge is likely to keep the children away from that parent. The judge may order supervised visits and therapy for the parent but initially they will keep the children away from that parent. If there is also proof of the other parent being into drugs or alcohol to the point where there is an issue then the judge may also decide against child custody for that parent.
Child custody can be a very hard thing to go through. For the parents and especially the children divorce is definitely life changing and sometimes it may be very hard on the children. They will need to know that they are safe and loved in both of their parents homes. Divorce of their parents does not mean that the children are being divorced and they should be reminded of that often. |
