Are you able to have your criminal record expunged?
- Posted at 07:08 on 2008-May-5 by Duncan Carver What exactly is a criminal record? For those people that do not have or have ever had a criminal record it may be hard to understand exactly what a criminal record really is. Does it mean that you are a bad person if you have a criminal record or does it mean that a mistake or two was made and that ended up causing you to have a criminal record? I guess the answer would depend on who exactly you asked the question to.
Criminal records occur when ever there is any kind of crime that is committed. That means any crime at all. From something as small as a misdemeanor or as big as a class A felony. There will be a criminal record that occurs for every crime that someone commits. If you already have a criminal record and you commit more crimes then your criminal record will just get larger and larger. Now if you are a career criminal and you are just constantly committing crimes either you are not the best of people or you have some serious issues, either way it is not likely that you can get your criminal record expunged. However depending on the attorney you have they may be able to work something out for you.
You see criminal records for people who are constantly committing crimes do not typically get expunged. A criminal record will be expunged for people that have committed a crime and they made a mistake. These are people that want to go on and live their lives to the fullest and not continuously live in a life of crime. The regulations to having your criminal record expunged are different in every state of the United States but they are quite similar. You will have to contact an attorney in your state if you are interested in having your criminal record expunged. So if you live in California then you will have to have a California attorney look into your case and see if you are able to qualify to have your criminal record sealed.
The basics of a criminal record being sealed are quite similar from state to state. You must not have any kind of criminal activity over a certain period of time. It is usually around five or more years but again it may vary from state to state. If you can show that you are not out there in the world constantly committing crimes you may be able to have your criminal record expunged. You must also make sure that none of the crimes that you have ever committed resulted in any kind of injury to anyone at all. That means that no one may have been killed or injured during or as a result of a crime you committed. This helps to make sure that violent criminals keep their criminal records known. Rapists and murders and criminals like that do not typically qualify to have their criminal records expunged.
In most states you must also have completed any probation or parole that was assigned to you. And you must have paid all and any fines and fees completely that the judge ordered you to pay. You must show that you are willing to make amends for the crime or crimes that you committed. Again all of these regulations to having your criminal record sealed or expunged may vary from state to state. So the best thing that you can do if you are interested in having your criminal record expunged is to contact an attorney in your local area or the area in which the crime was committed. A criminal record that has been expunged is a second chance.
- Posted at 11:06 on 2008-Apr-26 by Duncan Carver When someone has their criminal record expunged it means that their criminal record is sealed and it is no longer a part of the public record. When a criminal record is expunged it is taken away and no one can get a hold of it. Even if you are in a court of law you can legally say that you do not have a criminal record once your criminal record has been expunged. In fact the only way that anyone can get a hold of your criminal record once it has been expunged they would have to go through a court and a judge would have to have seen sufficient reason why the criminal record that has already been expunged be allowed to be opened back up again and that does not happen very easily rest assured. A criminal record is something that can haunt a person for the rest of their lives. When ever any type of criminal activity is committed a criminal record is established right away. Even for the smallest of infractions. Now the problem that everyday good people will face is that when a job application asks if you have a criminal record you have to say yes. Now by law the potential employer can not discriminate against you because you have a criminal record and all of the applications will always offer room to explain but once you put yes to that question the majority of employers will find another reason to not hire you. This can cause some very difficult financial hardships for many people. By getting your criminal record expunged that can not happen any longer. There will be career opportunities that were closed off from you before that will begin to open up. You will once again be able to feel like a normal part of society and not someone who is looked upon as a criminal. Even though there are many laws that are in place to protect people from any form of discrimination we all know that it still happens on a daily basis. There are people who have a criminal record that are turned away from the most basic of jobs every single day. These people are finding it difficult to survive with a criminal record. Now these people are not of course the career criminal people. these people are the ones who made a mistake or two when they were younger and have paid their debt to society whether through fines, probation, community service or even jail time and then parole. These people who are having a very hard time trying to get by in life are honest members of society now and have been for a long time. These are prime candidates for having their criminal records expunged. There are certain regulations that must occur before a person can get their criminal record expunged. The best thing that anyone can do is in fact retain an attorney right away and ask all of the questions that you have about criminal records being expunged. The attorney will be able to tell you if you are even able to qualify as a candidate to have your criminal record expunged. After a few questions are answered then the attorney will know right away if you should even pursue having your criminal record expunged or not. If you want to have your criminal record expunged then you need to make sure that you have fulfilled all of your fines, probation, jail time and any other things that the judge may have sentenced you to. it must be at least five years since your last offense. And most importantly there must not have been any kind of injury to anyone as a result of the crime you committed. These are all factors and any more of the requirements to having your criminal record expunged can be told to you by your attorney. |

Contacting an attorney to have your criminal record expunged.
- Posted at 06:32 on 2008-Apr-20 by Duncan Carver Criminal records are something that many people have and many people are affected by a criminal record in a very negative sense. There are people who automatically believe that if someone has a criminal record that they are automatically a very bad person and that they are not trustworthy and all kinds of other negative thoughts. The truth is that only some people who have criminal records are in fact like that. There are many people who have made a mistake in their lives and from that they now have a criminal record. There are some very bad people in the world today and it is important to have a criminal record on file for all of those people who really need to have a criminal record. But there are many people who now have criminal records because of a mistake that they made at one time in their lives or even other reasons. The problem with criminal records is that when you are filling out job applications or applications for buying a home or renting a home they will typically ask if you have a criminal record. You must answer truthfully and not lie so if you have a criminal record you should always answer honestly. Now this is where it gets tricky. Many places will check so if you put down that you do not have a criminal record and you do it could seriously hurt you when it comes back that you have a criminal record. If you do put down that you have a criminal record then the majority of people will not even consider you any further for the job or the home. They are not supposed to discriminate against you but it happens all of the time and they can just say that it was for another reason. That is the downside of a criminal record. If you are a good person who has made a mistake or two in your life and now suffer because of a criminal record you should really think about getting your criminal record expunged. By having your criminal record expunged you will be allowing your self to make a clean and fresh start. You will be able to get the jobs that you are not able to get with a criminal record and you will be able to live in the homes that you may not be able to live in because of your criminal record. Having a criminal record expunged can help to do this for many people. If you have made bad decisions in your past and now are seriously paying for it you should contact an attorney as soon as possible and discuss the prospect of having your criminal record expunged. What happens when a criminal record is expunged is that the criminal record is basically sealed up and technically no longer exists. That means that when you put down that you do not have a criminal record you are not lying. If you are in court and you say that you do not have a criminal record and you are under oath you are still telling the truth because a criminal record that is expunged is again basically nonexistent. Not just any one can get their criminal record expunged you have to really be a good person and not have had any more criminal activity for at least five years from your last criminal act. There must also have not been any injury that occurred in any of the crimes that you committed. There is actually a long list of requirements that must be met in order to have your criminal record expunged so contacting an attorney as soon as possible is your best bet. |

Are you able to have your criminal record expunged?
- Posted at 07:08 on 2008-Apr-13 by Duncan Carver
An attorney can advise you the best on if you would be able to have your criminal record expunged or not. There are certain requirements that must be met in order to even consider having a criminal record expunged by a court. By retaining an attorney for help with expunging a criminal record you will be able to get the full details of the requirements that you must meet. Some of the more important requirements though are fairly simple. They are in place to make sure that career criminals or people that have committed violent crimes can not have their criminal records expunged.
One of the first and most important requirements for having any sort of criminal record expunged would be that no one was killed or injured as a result of the crime that was committed. If there was any kind of injury that was caused by the crime that you committed then you can not have your criminal record expunged. Also there must have been at least five years of no criminal activity since the original crime was committed. You must have paid all fees and acquired penalties that the court had assigned you to pay and you must have completed any probation or parole that you had. There are more requirements that must be met before a criminal record can be sealed but an attorney would have complete and full knowledge of that.
There are these requirements that are set in place because having a criminal record expunged is not at all for the type of people that keep committing crimes. The whole idea of a criminal record being expunged is so that these people can lead a normal life in society again and not so they can just continue to commit more crimes. When someone continues to commit crimes they are not the type of people that deserve another chance at a good life. The expunging of a criminal record is not for people who have committed violent crimes because there were people that were injured and possibly lost their lives.
An attorney can tell you that getting a criminal record expunged may be hard to do and also may take some time to do it. You will also be responsible for any attorney’s fees that you must pay to your attorney. It is not an easy process to go through but for the most part it is worth it.
When a person gets a criminal record because of a mistake that he or she made a long time ago and since has paid their debt to society they should be able to have their criminal record expunged. They should be able to get the jobs that they want and to live where they would like to live. A criminal record can stop those things from happening and when it is all for a mistake that was made it just seems like a waste of a life and a possible future. If you are a person that has a criminal record because of a mistake that you made many years ago and would like to see if you can have your criminal record expunged then you should contact an attorney as soon as you possibly can do see if you are able to have your criminal record expunged. |

Expunge your criminal record.
- Posted at 07:22 on 2008-Apr-6 by Duncan Carver For anyone who has ever been convicted of a crime or for that matter even has been arrested there will be some kind of criminal record. Criminal records never go away and will follow a person for ever. If you are a person that has a criminal record you may find it difficult to obtain employment or even housing for your self and your family due to your criminal record and that can be very damaging to you.
Criminal records are there to help people identify criminals and to keep society safe from repeat offenders and bad criminals. That is the reason for the criminal record in the first place and it works fairly well when a person is a real criminal. But what happens when a good person makes a bad mistake and they find themselves with a criminal record and they may have difficulties finding employment and have a harder time supporting themselves and their family.
Now there are people out in the world today who continually commit crimes and are very bad people. Of course there are also people who have committed crimes in the past based on bad decisions and they are now past all of that and are trying to turn their lives around. Sometimes a criminal record can make that very hard to do. There are those people who are trying to turn their lives around and be a normal part of society and it may not be the easiest of things to do for them. For these people thinking about having their criminal record expunged would be a very good way to help get their lives back on track.
Having a criminal record expunged however not an easy process is at all. The very first thing that must be done is that an attorney must be retained to start the process. Once that is done the attorney will be able to tell you if you are even able to have your criminal record expunged. There are certain criteria that you must have fulfilled before you can think about having your criminal record expunged. One of the most important parts of having your criminal record sealed is that the crime that was committed must not have caused any kind of harm to anyone at all. That means that there must have been no kind of injury or death that occurred due to the crime you committed. That really is the most important part of the whole thing. No criminal record can ever be expunged if there was anyone that was hurt from a crime.
Criminal records can truly have a lasting effect on people and many times people need to have a clean slate in order to have their lives be normal. Supporting yourself and your family is very important and many times having a criminal record expunged can be the one thing that can help to set everything right in your life again. |

It's Damaging...
- Posted at 03:55 on 2008-Mar-24 by Duncan Carver Criminal records can be very damaging for so many people. Actually criminal records are damaging for any one that gets one. Criminal records may be more damaging to some people than other though and for that reason it is quite reasonable for some people to go about getting their criminal record expunged.
For any crime that is committed and any arrest that is made because someone has broken the law, a criminal record begins. If it is a one time crime the criminal record will start out and if it is one crime in a long list of crimes that have already been committed then that crime will be added to the already existing criminal record. If you are looking to have your criminal record expunged or sealed it may be harder for you to do if you have a long criminal record. If there are a number of crimes on your criminal record it could really work against you in having your criminal record expunged.
However if you have only a very short criminal record the odds of you getting your criminal record expunged would be greater than if it is a long criminal record. It is not an easy process to have a criminal record expunged to begin with so if you can make it even a little easier it would be best. Making it easier would be to not have a long criminal record with a lot of arrests on it. The first step in getting or trying to get your criminal record sealed would be to obtain an attorney right away. By obtaining an attorney to begin with you may be able to save yourself a lot of time that may be unnecessarily spent. You see an attorney will be able to tell you if you have any kind of chance to get your criminal record expunged or sealed right at the beginning. When you obtain an attorney they will be able to see if you even qualify for having your criminal record expunged.
There are certain requirements that you must meet if you are thinking about trying to have your criminal record expunged and an attorney can tell you if you meet those or not. There are several things that you must definitely have before you can even consider having your criminal record expunged. First you must make sure that any of the crimes that you committed did not in any way result in any type of injury to anyone. That means that if you committed a crime and someone was hurt or even killed as a result of the crime you will not be eligible to have your criminal record expunged at all.
You must have of course completed any kind of parole or probation that you were sentenced to and you must have done it honorably. That means completing the whole thing and paying any fines or fees that you were assigned. There also must be a certain number of years that have passed since your last crime was committed. There really are a number of things that you must meet in order to consider having your criminal record sealed and an attorney can truly help you in that field.
If you do qualify for getting your criminal record expunged and meet all of the criteria you will still have to have your case go before a judge. This judge will have the final say in the matter and of course it is beneficial to have an attorney present. Trying to have your criminal record expunged without an attorney is just not going to work so you need to get out there and find a good attorney to represent you. |

Do you meet the criteria to have your criminal record expunged?
- Posted at 01:46 on 2008-Mar-16 by Duncan Carver Criminal records are given to every person that has committed a crime. Criminal records do not ever go away on their own. If you asked about ever having a criminal record you must say that you have one even if you first received a criminal record many, many years ago. It does not matter. Once you have obtained a criminal record it will follow you for the rest of your life. The only way to have a criminal record go away would be to have the criminal record expunged.
Having a criminal record expunged is not an easy task at all. You should always retain an attorney when you are even considering having a criminal record expunged. Having an attorney is a great start in the process of having a criminal record expunged. But it is only the start of the whole process. Before you can even take your case in front of a judge and you will have to do that you must have certain criteria that you meet. Once you know if you meet all of the criteria you can then proceed with trying to have your criminal record expunged. And you must know that it is not always a sure thing. It will ultimately end up being the judge’s decision but you must start some where.
Some of the criteria that you must meet before you even go ahead with expunging your criminal record are relatively simple and there are actually many people with criminal records that would meet the criteria. One of the first and most important things is that you did not commit a violent crime. Also there must not have been any kind of injury that was a result of the crime that you committed. You must make sure that it was definitely a non violent crime and no one was injured as a result of what you did otherwise you will not be eligible at all for having your criminal record expunged.
Also you must have completed any probation or parole and must have done so honorably. It must have been at the least five years since any crime was committed by you. You must maintain a clean record for that time. There are several other things that you would have to meet in order to stand a chance to have your criminal record expunged but with out these basic qualifications you should not even bother to proceed with the process. Getting an attorney is really a great start. You will need an attorney to bring your case in front of a judge and also to file all of the necessary paperwork. After a period of time your attorney will be able to finally present your case in front of a judge and explain why you should be able to have your criminal record expunged. After the judge sees all of the information that your attorney will present to them the judge will make a final ruling on whether or not your criminal record will be expunged.
If your criminal record is expunged it could possibly mean a whole new life for some people and for others it can mean a way to start over again. Criminal records have a way of effecting people’s whole lives and can really make it difficult to live a normal life in society. For those people who worry about criminals having their criminal record sealed they should not. There can not be any type of violent criminal that can have his or her criminal record sealed or expunged and therefore no one should ever worry about that. |

How a criminal record can affect your life.
- Posted at 05:58 on 2008-Mar-10 by Duncan Carver Having a criminal record can affect many things in a person’s life. A criminal record can make it impossible for a person to get a good job or buy a home or even just rent a place to live. A criminal record can truly make living what most would consider a normal life very difficult indeed.
Criminal records can be from small crimes to very bad crimes. There is not any distinction between the crimes when it comes to a criminal record. Just because the crime that you committed is a lesser crime does not mean that you will not have a criminal record. A criminal record will start whenever any crime is committed big or small alike. Criminal records can really make living a normal life difficult for some people.
If you are looking for a job and you are filling out applications you will typically see a line for any kind of criminal record. These must be filled out honestly. Legally a potential employer can not use your criminal record for a reason not to hire you but it does happen like that all of the time. The employer may not say it is because you have a criminal record but really as soon as they see that line filled out potential employers will not even look at the rest of the application and just blame the reason for not hiring you on something else. This is illegal but it does happen all of the time. It is very hard to get a job when you have a criminal record.
It may also be hard to find somewhere to live because many people do not want to rent to someone who has a criminal record due to fear that something may happen to the property or some kind of illegal action will take place on the property. It is very hard to support your self and also to support a family when you can not find a job or even find a place to live because of your criminal record.
If this is the case for you or someone that you know you should suggest to the person to have the criminal record expunged. If it is you then you should see if you qualify to have your criminal record expunged. Expunging a criminal record can be one of the best things that someone can do in their lifetime. When you have your criminal record expunged it means that you will have your criminal record sealed and no one can see it. If you are filling out applications you do not have to say that you have a criminal record any longer. If you are trying to find a place to live you no longer have to say that you have a criminal record. And even if you are testifying in court and you are asked if you have a criminal record you do not have to say yes any longer. Having your criminal record expunged means that technically you do not have a criminal record any longer. If a court needs or wants to see your criminal record a judge must re open the criminal record and it must be for a very good reason.
There are some requirements that you must meet if you are thinking about having your criminal record expunged. So if this seems like it is something that you would be interested in then you should contact an attorney right away. Only an attorney can tell you if you are going to be able to be eligible to have your criminal record expunged or not. |

You will need a lawyer to get your criminal record expunged.
- Posted at 07:08 on 2008-Mar-4 by Duncan Carver A lot of people seem to have a criminal record in one way or another. There are a lot of people that also have DUI’s and they have a criminal record from that. Any kind of criminal record can be damaging no matter what the reason of having the criminal record. It can be all kinds of different charges on your criminal record or you can simply have a DUI and you will still have a criminal record.
Even though having a DUI is bad it is not as bad as murder or robbery or rape. Those are very bad crimes and people have gotten hurt in these situations. Now of course there are the situations when a person hurts some one in an accident or something and then the DUI becomes much more serious. And although a DUI is serious it is not as bad as hurting some one from a crime. DUI’s still can cause you to have a lot of issue. The DUI charges will still cause you to have a criminal record.
Criminal records have a funny way of sometimes making a person’s life very hard to live. If they have a family to support or they have a hard enough time trying to support them selves it may make it much more difficult if they have a criminal record. A criminal record will be asked about on every job interview that you go on. If you have a criminal record there are many employers that will not hire you. Of course they will not tell you that it is because of your criminal record that they are not going to hire you but it is usually the case. It may be very difficult to find employment and to find a good enough job to support you and your family.
When a person has a criminal record and they are having a hard time to support themselves and their family it may be the best thing to do to see if they can get their criminal record expunged. Getting a criminal record expunged means the same thing as getting your criminal record sealed. No one can open your criminal record once it is expunged. Even in court if you are asked if you have a criminal record and it has been expunged you can say no. There has to be a whole process done in order to re open an expunged criminal record.
Having a criminal record expunged can help a lot when it comes to having people hire you for jobs again. Since your criminal record is expunged you can legally say that you do not have a criminal record. By doing that you can once again be hired for a job that you are qualified for and not have to worry about not getting the job and you will not have to worry about how you are going to support your family again. By having a criminal record sealed or expunged it is a sure way to get a helping hand up again.
When someone needs to have a criminal record expunged they should always s contact a lawyer. A lawyer is definitely needed to have the whole criminal record expungement process start. It is something that you just need a lawyer to go in front of the court to set things in motion. Of course there are some requirements that must be met before you can even start to do the expungement but a lawyer will know all about those and that is why it is important to contact a lawyer as soon as you are ready to have your criminal record disappear for ever. |

Expunging your criminal record.
- Posted at 06:54 on 2008-Feb-25 by Duncan Carver Criminal records are what happen anytime an arrest is made. Any kind of judgment that is passed by a court in a criminal case will be put in a criminal record. Criminal records can be very short or in some cases very long. Criminal records stay with you for your whole life and even if you were crime free for thirty years a criminal record can still be accessed and used against you for something later on in life.
Criminal records just do not go away on their own and with every arrest that is made it just grows longer and longer. Now not everyone that has a criminal record is in fact a criminal. There are times when people make mistakes and they end up with a criminal record as a result of it. This is when a criminal record can be very damaging. For lifelong criminals a criminal record can of course be very damaging also but in cases where the person is a criminal and has a repeated history of criminal offenses the criminal record will have no way of being expunged or sealed. However in cases where a criminal record contains a few items and there are other provisions that are met a person can in fact have their criminal record expunged and they can then start to lead a normal life once again.
When a person is arrested for a crime they have to either plead guilty or innocent or the case is dismissed. But there is going to be a criminal record from it. If a person has just made a mistake and a bad decision their criminal record could in fact change their life. Jobs could be harder to find and certain career choices could be eliminated just because of the criminal record that was obtained by one mistake. In instances like this having a criminal record expunged is something that must be considered very carefully.
Having a criminal record expunged can be a very time consuming event. It can also become expensive after awhile. An attorney must be obtained to do this procedure and it must go in front of a judge. These can all take years to happen or if you have a little bit of luck and a good attorney it will not take nearly that long. But an attorney must be hired to follow through with the whole procedure. There are many different things that must happen before the criminal record can be sealed.
First of all the crime that occurred can not be violent in any way nor can there have been any kind of injury that occurred as a result of the crime. That is the most important aspect of the sealing of a criminal record. There can not be any criminal activity that occurred over a period of years and any and all fines, judgments, jail time or probations must have been fulfilled. With out these basic of elements being done there is no hope what so ever of even trying to get a criminal record sealed. There are other elements that must also take place but these are the most important. By finding an attorney that can help in getting your criminal record sealed they can also tell you if you should proceed with it at all of just stop because you do not have all of the requirements for the expunging of a criminal record. So if some or most of these requirements fit you or someone you know you should contact an attorney and see if you qualify for having your criminal record expunged. |

Can anyone access your criminal record?
- Posted at 04:15 on 2008-Feb-18 by Duncan Carver
Now criminal records are a matter of public record and there fore many people can access them. Your criminal record can be accessed by someone that may be a potential employer or by someone who is going to rent you a house or an apartment. They have a right to know who they are going to be dealing with on a day to day basis. Your criminal record may also be accessed by a school official if you are applying to a college. And of course your criminal record may be accessed by any law enforcement official, such as the police, the district attorney, a judge or any one else that may work for a law enforcement agency. Again your criminal record is a matter of public record and there are plenty of people that can access it easily. Even though the criminal record is considered a matter of public record there are actually a few states that would need the consent of the individual before accessing their criminal record, although most states allow access without consent.
There are two ways to look at the accessing of criminal records. First if you are the person that has a criminal record then you really would not want it to be accessed but if you are the person trying to find out information about someone that you may be living with or working with you would want to know if they had a criminal record. Of course if you are someone looking at the criminal records of another you must remember that every arrest is on there not just convictions. So someone may have been arrested and then found innocent or the case could have been dismissed and the record of it will still appear on the criminal record. So before passing judgment you should first understand the situation. People get arrested all of the time and nothing ever comes of it. It may have been a simple misunderstanding or some other kind of situation. Of course if you find a criminal record of someone and there is a ling list of arrests for attempted murder or something like that then you may want to rethink renting them some space in your home.
If you are the one with the criminal record you may not like the fact that anyone can access your criminal record. For those people that have small and minor infractions on their criminal record it can be hard to live their so called normal lives. A criminal record no matter how big or how small can make life hard for some people. It could make it impossible to obtain a job or to find a place to live. These are both very necessary to support your self and also to support a family. So having any kind of criminal record could be harmful for many people.
If you are a person with a criminal record and it is affecting your life you should seriously consider getting your criminal record expunged. By contacting an attorney in the area of your criminal record you will be able to find out if you are able to even qualify to get your criminal record sealed. But by having your criminal record expunged you will be able to lead a normal life again. |

Call an attorney and ask about having your criminal record expunged.
- Posted at 08:30 on 2008-Feb-11 by Duncan Carver Criminal records can affect people’s lives. That is a very basic and a very well known fact. It would stand to reason that a criminal record would affect someone’s life because of the crime involved but not everyone who has a criminal record really understands the consequences that come with having a criminal record.
If your criminal record was bad enough you were sure to have had a lawyer at one point. That lawyer was probably busy trying to keep you out of jail and free and the criminal record was not the major concern. If you had a bad enough crime then perhaps your attorney was considering having your charges lowered or even dropped if it was possible but a criminal record that would stick with you for the rest of your life was not the lawyers major concern and probably not your biggest concern either. But none the less a criminal record will come out of every criminal charge that someone obtains.
If the crime was a minor one you would still have a criminal record. If the crime was smaller in nature and there was not really any jail time being threatened a criminal record may in deed be some thing that was a concern. Criminal record can change someone’s life and there may be serious repercussions later on in life from a criminal record. A criminal record could really affect your life. If you were pursuing a career in law enforcement or a government agency a criminal record could squash those dreams very easily. Then you would be lost in a career choice and have to start over again.
A criminal record could not only affect what kind of career you would have but it would also affect the type of ordinary job you may get. On every job application there is a spot where they ask you if you have ever been arrested or if you have any kind of criminal record. Now by law a potential employer can not discriminate against you because you have a criminal record but there is nothing stopping that employer from putting that application accidentally at the bottom of the pile. Of course no one would admit to doing this as it is against the law but it happens all the time still. How are you supposed to support your family or your self if you can not even get a simple job?
This is when you should consider obtaining an attorney and seeing if you can get your criminal record expunged. If you have can get your criminal record expunged it would be a much better way of life for you and your family that you have now or that you will have in the future. You will be able to get jobs and do things that you may not have been able to do with a criminal record. When a criminal record is expunged it is like it never existed, even in a court of law.
There are a lot of requirements to having a criminal record expunged and you should obtain a lawyer to help you with the procedure. There must be papers that have to be filed with a court and there really are a lot of stipulations so obtaining an attorney would be in your best interest. If you have a criminal record that is affecting your life you should contact an attorney and ask some questions. You could be able to have your criminal record expunged and then perhaps be able to lead a better life. So find a lawyer and make a call to ask a couple of questions, it could not hurt you at all and only benefit you. |

Get your life back…have your criminal record expunged.
- Posted at 06:56 on 2008-Feb-4 by Duncan Carver
Having a criminal record expunged means that basically your criminal record is sealed. No one knows about it and you do not have to ever say that you have a criminal record. You can answer no to the questions about having a criminal record, even in a court situation. Once your criminal record is expunged you do not have to say you have a criminal record because technically you do not have one any longer.
For many people that is a dream come true. Having a criminal record could seriously affect someone’s life very drastically. People can be held back from positions in their jobs because of criminal records or they can even be fired due to having a criminal record. There are those people that may not ever even get the type of job that they were hoping for as their career and that again would be due to a criminal record.
Now for those people who are worried about the fact that a criminal can get their criminal record expunged must realize that we are not talking about the kind of people that have murdered, raped, or did anything terribly bad at all. These kinds of criminal records can not be sealed. There are some very strict guidelines that must be followed when you are trying to get a criminal record sealed. One of those guidelines is that no kind of injury could have happened while the crime was being committed or as a result of the crime. So if someone got a DUI or something like that and no one was injured or hurt in any way they may be able to qualify to get their criminal record expunged. There are many other factors that must be considered also before you can even think about getting a criminal record expunged. Basically getting a criminal record expunged is taking a good citizen that made a mistake and has repented for it and giving them their life back.
Most people do not realize the effects that having a criminal record can create for a person. Again the most important thing about a criminal record is that the career and the job that you may have wanted to be all of your life may not happen because of your criminal record. Also even getting a regular job could not be very easy. If you are asked on a job application if you have any kind of criminal record you must answer it honestly. Even if the crime happened over ten years ago you must answer it honestly. Most jobs will fire you on the spot if you lied on that application. Of course there is not supposed to be any kind of discrimination towards people with criminal records but we all know that as soon as an employer sees that there is some kind of criminal record that application goes into the trash and the person is not called back. This kind of thing happens every day and can be life changing for many people. What if that person has a family to support and can not find work because of their criminal record? This is something that happens every day all over the world. So if you have a criminal record you may want to contact an attorney and find out all of the specifics about having your criminal record expunged. |

Get your criminal record expunged and lead a normal life again.
- Posted at 02:29 on 2008-Jan-27 by Duncan Carver All throughout society there are some very good people that have made a bad mistake once or twice. These people may now have a criminal record and will find that a criminal record may indeed hinder your life some in many different aspects of it. a criminal record is nothing that should be taken lightly and unfortunately for the thousands of many people that have criminal records they have found out that lesson.
Criminal records can really affect many aspects of a person’s life. If someone is basically a good person and made some mistakes in their life they may end up paying for it their whole lives. If someone has a criminal record because of a DWI or a DUI they may not be able to do many of the things that people do every day. They may loose their license and also their jobs at times. This is a big way that a criminal record could affect someone’s life. If they are a repeat offender and have received several DWI or DUI then that is a whole other chapter. But if these people made a mistake once and then made amends after wards why should they be penalized their whole life for a mistake that they made years before. This is when a criminal record should be expunged.
In order to get a criminal record expunged a person must first contact an attorney. They can try to do it by them selves but that is highly not advisable. They should always get an attorney because of the seriousness of the situation. A person’s life depends on the way things work out and an attorney is very qualified and much more than a normal person to get the criminal record expunged. There are many court papers that must be filed and many motions and even plenty of requirements that must be done before the process even starts.
The person must not have injured anyone during their crime and they must have already served their sentence whether it was probation or finishing up with parole. These are definite requirements to getting your criminal record expunged. There are many more things that must be done in order to even allow someone to begin the expunging of their criminal record process and there are very strict rules about it. These are the issues that an attorney can advise you on and one should always be consulted when it comes to criminal records.
You can find an attorney in your local area if that is where you criminal record stems from. If you have a criminal record from somewhere else than where you currently reside then you will need to contact an attorney where ever it was that you first got the charges against you. So if you live in a different state than where you were arrested and charged with a DUI or a DWI than you should speak with an attorney in the state where you were arrested. This will help in the process of expunging your criminal record.
By expunging your criminal record you are allowing yourself to become a person of society again. People can not discriminate against you because you of your criminal record. There is not supposed to be any discrimination to begin with but it happens and it happens a lot. So once a criminal record is expunged you no longer have to even acknowledge the criminal record anymore. It is as if it never existed. That to some people is a wonderful way to live. And the people that have had their criminal record expunged are very glad indeed to once again be living a normal life. |

Getting a criminal record expunged
- Posted at 01:43 on 2008-Jan-20 by Duncan Carver Criminal records are something that many people do not really want to admit to having but they do have them none the less. Criminal records are something that will follow you around for your whole life usually. This is not anything that someone would be proud of having and a criminal record can sometimes hinder a person from living the kind of life that they had always dreamed about living.
When a criminal record hinders someone from living the life that they wish they had there may be something that they can do about it. a criminal record can sometimes be expunged. This means that the criminal record must be sealed and no longer will be a problem for anyone. Now this procedure does not just occur out of the blue. The person must have certain requirements regarding their criminal record. And then there is a very long and typically costly procedure that must follow. You must make sure that the crime that you committed did not harm anyone. That means that there were no injuries or worse to anyone that resulted from the crime that you committed. As long as there were no injuries you can proceed with the process usually. There are a few more requirements for being able to expunge your criminal record but that is the most serious requirement of them all.
Another requirement would be that there were no more crimes committed with in a certain amount of time. You must have finished all probation and/or parole conditions also. There are other requirements for you to expunge your criminal record and just taking a few moments to do some research will show you if you should even consider continuing with the idea of expunging your criminal record.
One of the many reasons that someone would want to get their criminal record expunged would be so that they can get a good job or a career. Having a criminal record can hinder you from many jobs and there are certainly a lot of careers that you can not even consider if you have a criminal record. For someone who wanted to go into a certain field of perhaps law enforcement, a criminal record would make that impossible. Not only are a number of career choices taken away from you but simply getting many jobs could be a difficult process.
There are usually questions pertaining to criminal records that are on the majority of job applications. You must always answer the questions about any criminal record honestly other wise if your employer finds out the truth you can and usually will be fired. But on the other side of the coin it is very hard to obtain a job if you have a criminal record on the application. Even though employers are not supposed to discriminate against you for having a criminal record they may just find a reason not to hire you anyway. This can be a very difficult thing to take with you through life. It may be very hard to find and even keep a job let alone a job that will allow you to support any kind of a family let alone yourself.
Getting a criminal record expunged can be very beneficial for many people. As long as the guidelines and the requirements are met then you should obtain an attorney that can petition the court and then hopefully start your expungement process. Now please do not think that this is a very easy thing to do because it is a lot of work and even in the end it is still up to a judge. But the hard work is all worth it in the end to have your criminal record expunged. |

If You Have A DWI or DUI You Have A Criminal Record.
- Posted at 07:45 on 2008-Jan-17 by Duncan Carver If you have gotten arrested for drinking while driving then you must read this article because it will help to give your life back.
When you have a criminal record it can follow you around for a long time, and make many things in your life much more difficult than it needs to be. Alright so you made a mistake, and I am sure that you regret it deeply and it’s not something that you are going to do again, so you don’t need to pay for it every waking moment of your life for the next years.
There is nothing easy about having a criminal record, and if you have tried to get a job then I am sure that you know how many employers will run a background check on you. Many companies will not hire you if you have one even if it’s a DWI or DUI. Think about it would you want to hire someone in your business if they got this, not unless you had gotten yours already. Because you’d probably be a little more compassionate about it. But you wouldn’t, and many employers don’t and won't.
So what do you do? What you need to do is get that criminal record sealed so the next time somebody tries to find a criminal record for you they won’t. The only way for you to get your criminal record sealed is by contacting an attorney. They will be able to help you get your life back completely.
You can even get your record sealed for other types of felonies, convictions and charges. There are some instances that you may not be able to seal your record and usually this greatly depends on the charges and the state that you live in.
There are many online lawyer websites that you can begin looking at to learn more about getting your criminal record sealed. Nobody deserves to continuously pay for their mistakes, not if they have accepted they messed up and do not plan on doing it again. And talking to an attorney and asking them to help you to seal your record is the only way that you can prevent anyone from finding that one night you decided to get into your car and drive home after you had a few drinks and most likely one or two too many.
So many people stupidly do this, but it’s not something that you should do again, and hopefully after getting locked up, losing your license and the many other not such fun things that go hand and hand with getting arrested for drinking and driving. There are many states that have a zero tolerance law, which means if you are going to be in a lot more trouble.
If you are ready to start feeling a huge weight lifted off of you than you should start looking for an attorney online or offline that will help you to seal your criminal record. This is not going to cost you an arm and a leg, but you have to pay. The amount depends on the severity of the charges that you have on your criminal record.
Be sure that you research the different attorneys before you pick any. This will help you to be sure that you are going to be giving your money to a lawyer that is going to be good enough, but also not bleed you dry. We all know how expensive some lawyers can be, so just do your homework first. |

Getting Rid Of Those Convictions
- Posted at 07:59 on 2008-Jan-9 by Duncan Carver Nobody wants to have a record out there stating that they are a criminal, but it happens. When you have convictions than you have a criminal record. If you have a criminal record it your potential employer that you are trying to get a job from has access to this criminal record. They are going to use this to make their final decision on whether or not you get the job. And we both know how that is going to end up now don’t we.
But applying for a job is not the only thing that is going to be difficult, there are so many other things that you wouldn’t even think of. I know that I didn’t. When you expunge your criminal record this doesn’t mean that you are erasing it. That just is not possible. Expunging your record is kind of like putting your criminal record in a safe place in case they need to find it again, judges are really the only ones that will be able to access this, law enforcement are not. But not just anyone can find it. If you get your criminal record expunged, and then you go on a job interview. When the employer runs a background check they are going to find absolutely nothing on you. It will say that there is no criminal record that exists for you. That’s a great thing isn’t it? Well it’s possible.
There are many lawyers on the internet that can help you to seal your criminal record. All you need to do is begin researching and learning more about the process, and find a good lawyer that will not cost you an arm and a leg, but will be very effective in getting your criminal record expunged. Not many people are going to want to employ someone that has a criminal record. This means that you are a higher risk to them and depending on what you were arrested for you stand the chance of not being able to get a good job at all whether you were arrested just once or several times. And if you live in Las Vegas you will definitely find it extremely hard to find a job. Nearly every job in Las Vegas will require you to get a background check, you will need to have a Sheriff’s card that will list your criminal record.
Another thing that is going to be hard for you is going back to school. Sounds funny, but it’s true. If you have a criminal record you are going to have a hard time finding a school that wants you there.
So what do you do when you are not able to move forward and better your life because of your mistakes? How on earth are you going to move forward in your life if you are unable to accomplish anything because of something that you have done once, or even more than once.
It’s really actually very simple. What you want to do is get your criminal record sealed. This is going to prevent employers and colleges from being able to see anything on your record. So when they look they will not find a thing and will never know about your past.
You will need to contact an attorney in order to accomplish this. This is going to be the only way that you are going to be able to move forward in your life, and keep the past the past.
Contacting an attorney and discussing what they can do for you is your only hope. There are many online attorneys that will be able to help you to seal your criminal record, and give you back your life. It’s important that you do your homework before paying just any attorney to do this for you. You want to be sure that the one that you plan on using is a reputable attorney. This will prevent you from wasting your money and your time.
It’s important that you also choose the attorney that is in your state. Each state has their own laws. So you can’t expect a California attorney to seal or expunge your criminal record if you live in New York.
Getting your criminal record will allow you to check that NO box on all of those job applications that ask if you have ever been arrested. There is so much relief that you are going to feel knowing that you can safely answer that question. Is a criminal record haunting you?
- Posted at 05:48 on 2007-Dec-10 by Duncan Carver
Criminal records really do have a way to stick with you forever. Even when it has been many years a potential employer or someone else may run across an old criminal record. When you have left something behind twenty years ago it is hard to get over it when it may still pop up later on in life. This is a hard thing to let go and that is why it is said that a criminal record will haunt you. This happens in many states but California has a very high percentage of people with criminal records and it is hard enough to get employment of any kind in California right now even with out a criminal record.
If you are a person that just made a bad decision and have lived your life according to the way society and the law has said you will still pay for that one mistake. That criminal record will follow you from job to job and from state to state and year after year it will still be there haunting you. There are some ways around a criminal record haunting you for the rest of your live though. You can try to have your criminal record expunged.
By having your criminal record expunged you are basically sealing your criminal record so it does not exist anymore. Of course you still know it exists but as far as other people are concerned it never happened. If you are asked on a job application if you have a criminal record you can say no and it is not considered lying. Even in a court of law and under a strict oath you can say that you do not have a criminal record and it would be the “truth” as far as the courts are concerned.
What happens is that the court seals your criminal record and it is not opened ever again unless a court decides it is necessary in some extreme cases. In the past a court would actually seal the criminal record shut and store it away so no one ever saw it. These days’ people do not really seal the record just store the file away.
Not everyone can get their criminal record sealed and in some states it is a bit more difficult to do than in another. To get your criminal record expunged in California is only a little difficult to do and there must be many elements that are met. First of all you must get an attorney to help you with the courts and the expungement of your criminal record. Then it will take time so be patient. The papers must be filed and you must pay the fees and then it must go in front of a court before it is done.
But even before all of that is done you must have shown that you are a functioning part of society. That you have performed all of the orders that the courts have given you like paying off any fines and probation, and there are restrictions on the types of criminal records that can be expunged. You can not have certain types of charges on your record. There are many stipulations to getting a criminal record expunged so you must check with an attorney to find out all of the specifics. But once it is done you will be able to live a better life without your criminal record haunting you ever again. |
