Are you a candidate for getting your criminal record sealed? - Posted at 08:53 on 2007-Nov-17 by Duncan Carver

There are many people who would like to seal their criminal records.  By having a criminal record a person has a harder time trying to succeed in a society that we have created.  Criminal records have ways of holding people back from their potential.

Of course if some one has been a career criminal and they have been in and out of jail over the years, the chances of them getting their record sealed is a little slim.  If a person who has made a mistake once when they were younger and it has been years since they had any kind of issue with the law would be a better candidate for getting their criminal record sealed.  If you have proof that you have mended your ways and paid your debt to society than a judge will be more likely to seal your record.

If you are a citizen that made a mistake you really should look into getting your criminal record sealed and make your life a bit easier to deal with.  When you are looking to get your criminal record sealed you must prove that you are worthy of this.  You must prove that you are now a rehabilitated individual and no longer desire to exist in a life of crime.

If you have a criminal record you should understand what getting your criminal record sealed actually means.  The term comes from earlier days of getting your criminal record sealed.  The record was actually placed in an envelope and the envelope was sealed with a wax seal.  The record was never to be opened of course a judge could order it to be reopened if the situation called for it.  Now getting your criminal record sealed just means that the court clerk is ordered by the judge to not reveal any information about the record or its existence to anyone that inquires.  You can actually say that you do not have a criminal record under oath or when you are applying for a job, or for any kind of situation where you are asked about a criminal record.  Once the criminal record is sealed it is as if it never existed.

Sealing a criminal record can be a little annoying and definatlye time consuming.  There are a few qualifications that you must of course have.  You must be at least 18 years old or five years must have passed since you completed your probation.  You must have successfully completed probation.  You must be off probation for more than six months.  You must have paid all fines and fees that were due.  You must have no open cases in any courts.  You were not charged with a serious violent felony.  A violent felony would consist of murder, rape, arson of an inhabited building, robbery with a deadly or dangerous weapon.  These are considered violent crimes and you will have a very hard time trying to convince a judge that you should be allowed to have your record sealed.

You must contact an attorney and file the necessary paperwork.  There are also organizations that are out there and can be found on the internet that are able and willing to assist people in getting their criminal record sealed.  By contacting one of these organizations you can have many questions answered and possibly be shown the right way to go in order to seal your criminal record.  It is going to take some money and for you to invest the time needed to do it but getting your criminal record sealed could truly benefit you and the future of your life.
